Terms of service.

Plain language. No surprises.

1. Acceptance

By creating an account or using the MyMissingNote app or website, you agree to these terms. If you do not agree, please do not use the service.

2. The service

MyMissingNote is a digital note-delivery service. It allows you (the trustor) to write notes, designate people who should receive them, and configure a Proof of Life (POL) schedule — a dead-man switch that triggers note delivery if you stop checking in.

The service has three types of participants:

  • Trustor — the registered account holder who creates and owns notes.
  • Trustee — a registered MyMissingNote user invited by the trustor to access a vault of notes.
  • Recipient — a non-registered contact (email or phone) who receives note disclosures by link when the POL escalates.

3. Eligibility

You must be at least 18 years old to create an account. By registering, you confirm that you meet this requirement. The service is not directed at children.

4. Your account

You are responsible for keeping your login credentials confidential. Because note content is end-to-end encrypted using a key derived from your password, we cannot recover your notes if you forget your password. You are solely responsible for maintaining access to your account.

You must provide accurate information when registering. You may not create an account on behalf of another person without their knowledge.

5. Your content

Notes you create remain your property. By storing them on our servers, you grant us the limited right to store and process the encrypted ciphertext solely to provide the service. We cannot access or read the contents of your notes.

You are solely responsible for the content of your notes. You agree not to use the service to store or transmit content that is unlawful, harmful, harassing, defamatory, or that infringes third-party rights.

6. Proof of Life and note disclosure

The POL mechanism is the core function of MyMissingNote. You configure a check-in schedule. If you miss enough check-ins, the POL escalates and eventually triggers automatic delivery of your notes to your designated recipients and trustees.

You acknowledge and accept that:

  • Note delivery is automated and irreversible once triggered. Disclosed notes cannot be recalled from recipients who have already viewed them.
  • It is your responsibility to configure POL settings accurately and to check in on schedule. We are not liable for unintended disclosures caused by missed check-ins.
  • Delivery depends on recipients having valid, accessible email addresses. We are not liable for non-delivery caused by invalid addresses, spam filters, or factors outside our control.
  • The service is designed to complement — not replace — legal instruments such as a will, power of attorney, or estate plan. Notes delivered by MyMissingNote do not carry legal weight as a binding document.

7. End-to-end encryption and data recovery

Note content is encrypted client-side with a key derived from your password. We store only the encrypted ciphertext and cannot decrypt it under any circumstances. This means:

  • If you lose access to your account or forget your password, your note content cannot be recovered by us.
  • We cannot comply with requests to produce note content in response to legal process, because we do not hold the decryption key.
  • You are solely responsible for maintaining the means to decrypt your own content.

8. Acceptable use

You agree not to:

  • Use the service for any unlawful purpose or in violation of any applicable law.
  • Attempt to gain unauthorised access to any account, system, or data.
  • Interfere with or disrupt the service or its infrastructure.
  • Use automated tools to access the service in a way that exceeds reasonable personal use.
  • Impersonate another person or misrepresent your identity when inviting trustees or designating recipients.
  • Designate recipients or trustees without their knowledge or consent.

9. Service availability

We aim to keep MyMissingNote available at all times, but we do not guarantee uninterrupted access. We may perform maintenance, apply updates, or experience outages. We will make reasonable efforts to notify users of planned downtime.

Given the nature of the service (time-sensitive note delivery), we strongly recommend that you keep your contact details and recipient addresses up to date and verify your POL configuration regularly.

10. Intellectual property

All content on the MyMissingNote website and app — including text, design, logos, and code — is owned by or licensed to MyMissingNote. You may not reproduce, distribute, or create derivative works without our written permission. Your notes remain your own property.

11. Disclaimers

The service is provided "as is". We make no warranties — express or implied — about its fitness for any particular purpose, including but not limited to the reliable and timely delivery of notes after POL escalation.

MyMissingNote does not provide legal, financial, medical, or estate planning advice. The service is a personal communication tool and should be used alongside — not instead of — appropriate legal and professional arrangements.

12. Limitation of liability

To the fullest extent permitted by Dutch law, MyMissingNote is not liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to:

  • Loss of note content due to forgotten passwords or lost account access.
  • Unintended note disclosure resulting from misconfigured POL settings.
  • Failure to deliver notes due to invalid recipient addresses or third-party delivery issues.
  • Any reliance placed on the service as a substitute for legal instruments.

Our total aggregate liability for any claim arising from these terms or your use of the service is limited to the greater of the amount you paid us in the 12 months preceding the claim, or €100.

13. Account termination

You may delete your account at any time from within the app. Upon deletion, your data is marked as deleted and permanently removed from our systems within 90 days. Note disclosures that have already been sent to recipients cannot be recalled.

We reserve the right to suspend or terminate accounts that violate these terms, with notice where practicable.

14. Third-party links and services

The service relies on third-party infrastructure (see our Privacy Policy for details). We are not responsible for the practices or content of third-party services.

15. Governing law

These terms are governed by the laws of the Netherlands. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Amsterdam, unless mandatory consumer protection law in your country of residence requires otherwise.

16. Changes to these terms

We may update these terms as the service evolves. For material changes, we will notify you by email or in-app notice at least 14 days before they take effect. Continued use of the service after that date constitutes acceptance of the revised terms.
